⚖️ Conflict with the United States

In January 2003, theWTO 'sDispute Settlement Body (DSB ) ruled that the USContinued Dumping and Subsidy Offset Act ( CDSOA ) was incompatible with US WTO commitments.

This law enabled the United States to redistribute the anti-dumping duties collected to American companies.

Reaction from the European Union

The US has not amended its legislation, which has led the EU to request authorization to suspend some of its tariff concessions to the US (i.e. impose additional taxes in compensation).

This suspension was submitted to arbitration, and on August 31, 2004, the arbitrators set the annual amount of injury suffered by the EU at 72% of US CDSOA payments linked to European imports.

💸 Amount of compensation

For fiscal 2004 (Oct. 2003 - Sept. 2004), this corresponded to $27.81 million.

The EU was therefore authorized to impose an additional 15% import duty on certain US products, starting on May 1, 2005, until this value was reached:

  • Council Regulation (EC) n°673/2005 of April 25, 2005 establishing additional customs duties on imports of certain products originating in the United States of America;
  • Regulation (EU) 2018/196 of the European Parliament and of the Council of February 7, 2018 on additional customs duties on imports of certain products originating in the United States of America(replaces the previous one).

⚙️ Annual update by the Commission

Each year, if the United States fails to comply, the European Commission must adjust :

  • The rate of additional import duty
  • Or the list of products concerned

These adjustments led to the application of additional duties, which gradually decreased over time.

🔄 2024

On November 22, 2024, the authorities in the United States of America published the 2024 annual report on CDSOA payments.

For the year 2024, payments made under the CDSOA in relation to anti-dumping or countervailing duties paid on imports from the European Union amounted to USD 321.48.

Therefore, pursuant to Article 3(4) of Regulation (EU) 2018/196, theapplication of the additional duty is suspended concerning the following products:

    • 0710 40 00: sweet corn🌽
    • ex 9003 19 00: spectacle frames of base metal👓
    • 8705 10 00: truck cranes🚚🏗️
    • 6204 62 31: cotton denim pants and breeches 👖

This additional ad valorem duty represented 0.164% for the period from May 1, 2023 to May 1, 2025.
